    To access and use the full range of features provided by Imaginix AI, users must register for an account. During the registration process, users are required to provide accurate and complete information, including but not limited to their full name, email address, and a secure password.

    User registration onboarding is provided by Clerk Authentication and all the user's data is secured by Clerk.

    By creating an account, users agree to:

    • Maintain accurate and updated account details.
    • Use the account solely for personal or authorized business purposes.
    • Ensure that all information provided is truthful and does not impersonate another individual or entity.
    Failure to provide accurate information may result in restricted access or account termination.

    3.2 Account Security

    Imaginix AI uses industry-standard security software to protect user accounts and data.

    However, users are responsible for maintaining the security of their account credentials and taking necessary precautions to prevent unauthorized access.

    Imaginix AI is not liable for any unauthorized use of user accounts resulting from negligence or failure to secure login information.

    To ensure account security, users must:

    • Choose a strong and unique password.
    • Enable two-factor authentication (if available) for additional security.
    • Promptly notify Imaginix AI of any unauthorized access or suspected security breaches.
    • Avoid sharing account credentials with third parties.

    Imaginix AI shall not be held liable for any loss or damage resulting from unauthorized account access due to user negligence.

    3.3 Eligibility Criteria

    By registering an account, users affirm that they meet the following eligibility requirements:

    • You must be at least 13 years old or the minimum age required in your country to consent to use the Services.

    Violation of these restrictions may lead to account suspension or permanent termination.

    3.5 Suspension and Termination of Accounts

    Users whose accounts are suspended or terminated may lose access to stored images, settings, and other related data. Imaginix AI shall not be held liable for any loss resulting from account termination due to violations or security concerns.

    4. Use of Services

    Imaginix AI provides an AI-powered image editing platform designed for personal and professional use. By using the platform, users agree to:

    • Utilize the services only for lawful and authorized purposes.
    • Respect the rights and intellectual property of others.
    • Adhere to all applicable laws and regulations governing digital content and AI-generated images.
    • Use the platform in a manner that does not disrupt or compromise its functionality, security, or other users' experience.

    4.2 Prohibited Activities

    Users must not engage in any activity that may harm, exploit, or abuse the platform, including but not limited to:

    • Illegal or Harmful Content: Uploading, generating, or distributing images that contain unlawful, explicit, defamatory, violent, or abusive content.
    • Copyright Infringement: Using the platform to create or modify images in a way that violates intellectual property laws, including unauthorized reproduction of copyrighted materials.
    • Misuse of AI Features: Manipulating AI tools to create misleading, deceptive, or manipulated content that promotes misinformation or fraud.
    • Security Violations: Attempting to hack, bypass security measures, or gain unauthorized access to Imaginix AI's systems or other users' accounts.
    • Automated Usage : Using bots, scripts, or automated tools to interact with the platform in a way that may disrupt normal operations.
    • Excessive Bandwidth Usage: Engaging in activities that put an unreasonable load on our servers, affecting service performance.
    • Resale or Redistribution: Selling, renting, sublicensing, or otherwise distributing any content or functionality of Imaginix AI without explicit permission.
    Violation of these restrictions may result in account suspension, legal action, or permanent termination of access to the platform.

    4.3 AI-Generated Content Responsibility

    Users acknowledge and accept that:

    • AI-generated images may not always be 100% accurate, ethical, or suitable for all purposes.
    • Users are fully responsible for how they use and distribute content created using Imaginix AI.
    • The platform does not guarantee that AI-generated content will be free from bias, distortion, or unintended elements.
    • Any misuse of AI-generated content that leads to harm, misinformation, or legal violations is solely the user's responsibility.

    4.4 Service Availability and Modifications

    Imaginix AI strives to ensure reliable service, but we do not guarantee uninterrupted availability of the platform. We may:

    • Temporarily or permanently suspend services for maintenance, upgrades, or unforeseen issues.
    • Modify, add, or remove features to improve user experience or comply with industry standards.
    • Restrict access to certain functionalities for compliance or security reasons.

    Users acknowledge that service interruptions or modifications may occur without prior notice, and Imaginix AI shall not be liable for any loss, inconvenience, or damages resulting from such changes.

    5. Intellectual Property Rights

    5.1 Ownership of Platform and Technology

    Imaginix AI, including its software, algorithms, user interface, and all associated intellectual property, is the exclusive property of Imaginix AI and its licensors. By using our platform, users acknowledge and agree that:

    • All rights, title, and interest in the Imaginix AI software, editing tools, and proprietary technology remain solely with Imaginix AI.
    • Users are granted a limited, non-exclusive, revocable license to access and use the platform for personal or commercial image editing, subject to these Terms of Use.
    • No part of the platform—including code, designs, features, or branding—may be copied, modified, distributed, or reverse-engineered without explicit written permission from Imaginix AI.

    5.2 User Content and Image Ownership

    Imaginix AI does not claim ownership of the images uploaded or edited by users. Users retain full ownership of their content, including all intellectual property rights associated with their original and edited images.

    However, users grant Imaginix AI the necessary rights to process, modify, and temporarily store their images for the purpose of providing editing services.

    By using the platform, users agree that:

    • They own or have the legal right to upload and edit any image submitted to Imaginix.
    • They remain solely responsible for ensuring that their uploaded and edited images do not infringe on third-party copyrights, trademarks, or privacy rights.
    • Imaginix AI does not store images permanently—files are processed and temporarily cached for service functionality, after which they are deleted in accordance with our data retention policies.

    5.3 Restrictions on Use of Edited Images

    Users are prohibited from using Imaginix AI's services to edit images in ways that:

    • Violate copyright laws: such as modifying copyrighted images without proper authorization.
    • Create misleading, deceptive, or harmful content: including edited images that spread false information or defame individuals or entities.
    • Infringe on trademarks: such as altering brand logos or copyrighted works without permission.
    • Violate privacy rights: by editing images to reveal sensitive or private information about individuals without consent.
    • Manipulate identity or impersonate othersthat leads to fraud, misinformation, or unethical use.

    Users acknowledge that Imaginix AI holds no liability for how edited images are used once they leave the platform. Any legal issues arising from improper use of modified images are the sole responsibility of the user.

    5.4 Trademarks and Branding

    The Imaginix AI name, logo, and branding elements are trademarks owned exclusively by Imaginix AI. Users may not use, reproduce, or alter these trademarks without prior written consent. Any unauthorized use of our brand elements may result in legal action.

    5.5 Reporting Copyright Infringement

    If you believe that any content edited or modified using Imaginix AI infringes on your intellectual property rights, please contact us immediately with:

    • A description of the copyrighted material that you believe has been infringed.
    • Proof of ownership or authorization to act on behalf of the copyright holder.
    • Details of the infringing content, including evidence of its unauthorized use.

    We take intellectual property concerns seriously and will take appropriate action, including content removal and account suspension if necessary.

    6. AI Models & Technology

    Imaginix AI leverages both third-party AI models and our proprietary AI model IMAGINIX 0.7 and our AI agent IDEON 4.2 to deliver advanced image, video, and code generation services.

    6.1 IMAGINIX 0.7 Model:

    • We integrate and utilize our own AI model to enhance our platform's capabilities. These models are designed to provide appropriate outputs and this model is not available to use in any other projects. By using Imaginix AI, you acknowledge and agree to comply with those terms where applicable.
    • While we strive for accuracy and reliability, our proprietary AI model is designed to minimize inaccuracies and biases. However, as with any AI system, unintended results may still occur. Users are encouraged to review outputs carefully and provide feedback to help us improve the model's performance.

    6.2 Third-Party AI Models:

    • We integrate and utilize third-party AI models to enhance our platform's capabilities. These models are governed by their respective providers' terms, and by using Imaginix AI, you acknowledge and agree to comply with those terms where applicable.
    • While we strive for accuracy and reliability, we do not have full control over third-party AI outputs, and we disclaim liability for any inaccuracies, biases, or unintended results.

    6.3 Our Proprietary AI Agent:

    • Imaginix AI also features a custom-built AI agent, designed to optimize, enhance, and regulate AI-generated content within our platform.
    • This AI agent provides additional functionality, improving user experience and ensuring responsible AI usage in alignment with our Terms of Service and Code of Conduct.
    By using Imaginix AI, you acknowledge that some outputs may be generated using external AI models, while our AI agent enhances and moderates the results to maintain quality and ethical standards.

    7. User Responsibilities and Conduct

    By accessing and using Imaginix AI, you acknowledge and accept that you are responsible for your actions on the platform. You must ensure that your use of the platform aligns with legal, ethical, and community guidelines. As a user, you are expected to:

    • Maintain accurate and truthful account information at all times, ensuring that your registered credentials are up-to-date and secure.
    • Use Imaginix AI's services for lawful purposes only, refraining from activities that could compromise platform security, exploit vulnerabilities, or cause harm to others.
    • Respect intellectual property rights, ensuring that any images uploaded or edited do not violate copyright, trademarks, or licensing agreements.
    • Act responsibly when modifying images, ensuring that AI-assisted enhancements are not used to mislead, manipulate, or defame individuals.
    • Comply with all applicable laws and regulations, including those related to data protection, privacy, and user-generated content.
    Failure to meet these responsibilities may result in restricted access to services, content removal, or legal consequences.

    7.2 Prohibited Activities

    To ensure the integrity and security of Imaginix AI, users must not engage in any of the following:

    A. Platform Misuse and Security Violations

    • Unauthorized access to any part of the platform, including restricted areas, administrative functions, or backend systems.
    • Reverse engineering, decompiling, or modifying any aspect of Imaginix AI's software or algorithms.
    • Deploying automated scripts, bots, or programs designed to overload, disrupt, or manipulate the platform's functionality.
    • Attempting to bypass security features, authentication processes, or access controls.
    • Engaging in fraudulent activities, such as impersonating another user or creating multiple accounts for deceptive purposes.

    B. Uploading Illegal or Harmful Content

    Users are strictly prohibited from processing images that contain:

    • Explicit violence, including depictions of abuse, torture, or harm to individuals or animals.
    • Hate speech or discriminatory content, including material that promotes racism, homophobia, or other forms of discrimination.
    • Misleading or fraudulent documents, including fake IDs, forged signatures, or altered legal paperwork.
    • Attempting to bypass security features, authentication processes, or access controls.
    • Defamatory, libelous, or slanderous modifications, intended to spread misinformation or harm an individual's reputation.
    • Any content that violates privacy laws, such as images containing personal identification numbers, financial records, or medical information without consent.

    7.3 Sensitive Content Restrictions

    Certain types of content are strictly prohibited from being uploaded, edited, or processed using Imaginix AI. Users are required to adhere to the following restrictions (The following points shows the restrictions):

    A. Exploitation and Child Safety

    • Any image depicting minors in a inappropriate manner.
    • AI-modified images that create misleading representations of children or underage individuals.
    • Attempts to bypass content moderation or upload restricted material under false pretenses.

    B. Mature or Harmful Content

    • Any form of mature explicit imagery that are not appropriate for children or underage individuals.
    • AI-assisted modifications intended to undress, alter, or manipulate images in a non-consensual manner.
    • Deepfake technology used for the creation or alteration of explicit content.

    C. Extremist or Criminal Content

    • Terrorism-related imagery or propaganda promoting extremist ideologies.
    • Weapons, drugs, or criminal-related content that could be used for illegal activities.
    • Material advocating for illegal conduct, including hacking, financial fraud, or identity theft.
    Users who repeatedly engage in prohibited activities will face stricter legal actions.

    7.4 Ethical Use and Community Standards

    Users must act responsibly and ethically when using Imaginix AI. In addition to legal compliance, this includes:

    • Engaging in ethical AI usage, ensuring that edited images are not used for deception or manipulation.
    • Respecting community guidelines, avoiding content that disrupts, offends, or endangers others.
    • Upholding integrity and transparency, ensuring that AI-modified images do not spread misinformation.
    • Avoiding malicious intent, including attempts to harm individuals, businesses, or public figures through manipulated content.

    7.5 Consequences of Violations

    Any breach of these terms may result in:

    • Immediate removal of non-compliant content from the platform.
    • Suspension or termination of user accounts, depending on the severity of the violation.
    • Legal consequences, including cooperation with law enforcement agencies when required.
    • Revocation of access to Imaginix AI services, without the possibility of reactivation.

    8. Accountability and Enforcement Measures

    Imaginix AI is committed to maintaining a secure, ethical, and legally compliant platform. To achieve this, we have strict enforcement mechanisms in place to address any violations of these Terms of Use.     • Temporary restrictions on the use of certain features.
    • A requirement to review and acknowledge compliance policies.

    B. Moderate Violations

    Moderate violations involve repeated offenses or actions that begin to affect platform integrity. These include:

    • Uploading AI-enhanced images that could mislead or deceive viewers.
    • Repeated attempts to edit and share content that violates sensitive content policies.
    • Attempting to bypass Imaginix AI's moderation or security systems.

    Consequences:

    • Content removal without prior notice.
    • Temporary account suspension (ranging from a few days to several weeks).
    • Restrictions on specific editing tools and sharing capabilities.

    C. Severe Violations

    Severe violations pose a serious risk to platform security, legal compliance, or public safety. Examples include:

    • Uploading explicit, violent, illegal, or exploitative images.
    • Using Imaginix AI for fraudulent activities, including identity manipulation or deepfake generation.
    • Engaging in harassment, defamation, or spreading misinformation through edited images.
    • Repeated violations after receiving prior warnings and suspensions.

    Consequences:

    • Immediate and permanent account termination.
    • Reporting of illegal activities to law enforcement agencies.
    • Permanent blacklisting of associated IP addresses and email domains.
    • Possible legal action for severe cases of policy abuse.

    D. Reporting Violations and Appeal Process

    Users who identify a violation of these terms are encouraged to report it using the platform's built-in reporting tools or by contacting our compliance team. Imaginix AI ensures that all reports are reviewed fairly and impartially.

    If a user believes enforcement action was taken unfairly, they may submit an appeal. The appeal process includes:

    By using Imaginix AI, users acknowledge and agree that:

    • User-Generated Content: While users retain rights to their original uploaded images, any AI-modified content may be subject to specific usage policies outlined in our Content Usage Guidelines.
    • Prohibited Actions: Users may not reverse-engineer, decompile, or attempt to extract the source code of any proprietary software or technology embedded in Imaginix AI.
    • Trademark Protection: The name, logo, and branding elements of Imaginix AI are legally protected trademarks and may not be used without prior authorization.

    Any copyright infringement or unauthorized use of Imaginix AI's intellectual property may result in legal action, termination of account access, and financial penalties as per applicable copyright laws.
